1. Scope

These General Terms and Conditions apply to all transport and travel services provided by Hergert Reisen, in particular for day trips, multi-day trips, excursions and group trips as well as bus charter services.

2. Conclusion of the contract

By registering, the customer makes a binding offer to conclude a travel contract. A contract is concluded upon acceptance/confirmation by the organizer.

2a. Booking methods and binding nature

Bookings can be made via the website www.hergertreisen.de , by email, telephone or WhatsApp.
A binding travel contract is concluded upon confirmation of the booking by the organizer.
By concluding the contract, the customer acknowledges these terms and conditions, including the cancellation policy.

3. Payment terms
• 20% deposit upon booking
• Final payment due 14 days before departure
• For short-notice bookings within 14 days, the full price is due immediately.
• If payment is not received on time, the organizer may withdraw from the contract and demand cancellation fees.

4. Scope of services

The scope is defined in the travel description and the booking confirmation.
Minor changes to the itinerary are reserved, provided they do not affect the overall character of the trip.

5. Price changes

Price changes are possible in the event of demonstrably unexpected cost increases (fuel, tolls, taxes) after the conclusion of the contract.
If the price increases by more than 8%, the customer can withdraw free of charge.

6. Withdrawal / Cancellation by the Customer (§ 651h BGB)

Up to 30 days 10%
29–15 days 25%
14–7 days 50%
6–2 days 80%
1 day / No-show 100%

The customer retains the right to prove lower costs.

7. Cancellation by the organizer

Possible at:
• Failure to reach the minimum number of participants
• force majeure / official regulations
• if participants endanger safety

8. Liability

The statutory liability regulations apply.
No liability is accepted for delays caused by traffic / congestion / weather, loss of personal belongings or valuables.
Liability limits according to the Passenger Transport Act (PBefG) and the Road Traffic Act (StVG).

9. Duty to cooperate

The customer is obliged to report any complaints immediately to the tour guide or the organizer.

10. Insurance

It is recommended to take out travel cancellation and baggage insurance.

11. Data Protection

This is done in accordance with the GDPR, see the privacy policy at www.hergertreisen.de .

12. Place of jurisdiction

For merchants: Odenthal, otherwise statutory regulations apply.

13. Severability Clause

Invalid provisions do not affect the validity of the remaining parts.

Additional terms and conditions for charter trips / group bookings
• Offer valid for 14 days
• Final number of passengers must be determined no later than 7 days before departure
• Additional mileage and time will be charged according to the actual costs incurred.
• Heavy soiling: Cleaning fee €150
• Damages caused by participants must be compensated
